Criminal Subpoena Policy

Our Privacy Policy prohibits the release of customer or account information without permission from the customer, except under limited circumstances; such as when required to comply with law or legal process, properly served on Web Guy or one of our affiliates.

Web Guy is not liable to any criminal activities conducted by users or a customer using our services. We are equally not liable to any claims resulting from resources or content provided by a client in correspondence to building a website, hosting or related services.

Furthermore, we reserve the right to terminate any account, should we realize or suspect that it is used in conducting unlawful actions, as indicated by local laws.

If you seek the identity or account information of a Web Guy customer in connection with a criminal activity, and you are a member of the law enforcement community, you must fax, mail, or serve Web Guy with a valid subpoena.

Background Documentation
Web Guy reserves the right to request a copy of the complaint and any supporting documentation that demonstrates how the Web Guy customer information is related to the pending litigation and the underlying subpoena.

Notice to Customer and Response Time
Upon the receipt of a valid criminal subpoena, unless the circumstances or subpoena warrant otherwise, Web Guy may promptly notify the customer whose information is sought via e-mail or mail. If the circumstances do not amount to an emergency, Web Guy may not immediately produce the customer information sought by the subpoena and may provide the customer an opportunity to move to challenge the subpoena in court. We reserve the right to charge an administration fee by charging the customer’s account.

Policy Regarding Email
Except as required by an order in accordance with Criminal or Local Laws. issued by a court of competent jurisdiction, Web Guy will not produce the content of e-mail or other electronic communications sent to the customer. Whether or not Web Guy gives its customer advance notice of any such disclosure will be governed by the terms of the Order or data laws.

Modification of Policy
Web Guy reserves the right to modify this policy at any time in its sole discretion.
